By accessing or using the Cleverpetz website (cleverpetz.pet), mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Gmax Central, LLC d/b/a Cleverpetz ("Cleverpetz," "we," "us," or "our"), located at 500 Westover Dr #92909, Sanford, NC 27330.

IMPORTANT: All content, AI-generated supplement suggestions, DNA analysis results, and product recommendations provided through our Services are intended for general pet wellness and informational purposes ONLY. They do NOT constitute veterinary medical advice, diagnosis, or treatment. Our AI-powered recommendation engine analyses genetic marker data to suggest wellness supplements tailored to your pet's breed profile. These suggestions are based on general breed-level wellness research and are NOT a substitute for professional veterinary care. You should ALWAYS consult a licensed veterinarian before starting any supplement regimen for your pet, particularly if your pet: • Has a diagnosed medical condition • Is currently taking prescription medications • Is pregnant, nursing, or under 12 weeks of age • Has recently undergone surgery or medical treatment Cleverpetz expressly disclaims any liability for decisions made based on AI-generated recommendations without prior veterinary consultation.

Our product formulations have been developed with input from licensed veterinary professionals ("Veterinary Advisors"). This means our Veterinary Advisors have reviewed the ingredient selection, dosage ranges, and contraindication guidelines used in our product line. "Formulated with veterinary guidance" means: ✓ Product formulas reviewed by licensed DVMs for safety and appropriateness ✓ Ingredient selection informed by peer-reviewed veterinary nutrition research ✓ Dosage guidelines validated against established veterinary standards "Formulated with veterinary guidance" does NOT mean: ✗ That a veterinarian has examined your specific pet ✗ That our products are prescribed or recommended for any specific medical condition ✗ That our AI recommendations constitute a veterinary consultation ✗ That our products have been approved by the FDA, USDA, or any regulatory body as treatments for disease

Our AI recommendation engine ("CleverAI") uses genetic marker data from your pet's DNA test to generate personalised wellness supplement suggestions. By using CleverAI, you acknowledge and agree that: (a) CleverAI recommendations are algorithmic suggestions based on breed-level genetic data and are not individualised medical assessments; (b) The accuracy of recommendations depends on the quality and completeness of DNA sample submission; (c) Genetic predispositions identified by CleverAI do not guarantee your pet will develop any particular condition; (d) Cleverpetz makes no warranty that CleverAI recommendations will prevent, treat, or cure any disease or health condition; (e) You assume full responsibility for decisions made based on CleverAI output.

By submitting a DNA sample through our Services, you grant Cleverpetz a limited licence to process and analyse the genetic data for the purpose of generating wellness recommendations. We handle pet DNA data as follows: Data Use: Pet DNA data is used solely to generate supplement recommendations and improve our AI models. We do not sell individual pet genetic data to third parties. Data Retention: Raw DNA sample data is retained for up to 24 months to allow re-analysis as our AI improves. You may request deletion at any time by emailing [email protected]. Anonymisation: Aggregate, anonymised genetic data may be used for research and product development purposes. Third-Party Processing: DNA samples are processed by our certified laboratory partners under strict confidentiality agreements compliant with applicable data protection laws. Your Rights: Depending on your jurisdiction, you may have rights to access, correct, or delete your pet's genetic data. See our Privacy Policy for full details.

Our dietary supplement products have not been evaluated by the Food and Drug Administration (FDA). These products are not intended to diagnose, treat, cure, or prevent any disease. This statement applies to all Cleverpetz supplement products sold in the United States. For customers in Canada: Our products are sold as general wellness supplements. Products making health claims in Canada require a Natural Product Number (NPN) from Health Canada. We are in the process of obtaining applicable NPNs for our product line. For customers in the United Kingdom: Our products comply with applicable UK food supplement regulations. They are not licensed medicinal products. Product results may vary. Individual pet responses to supplements depend on factors including breed, age, existing health conditions, diet, and lifestyle.

All content on the Cleverpetz website, including but not limited to text, graphics, logos, images, AI algorithms, and software, is the property of Gmax Central, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEVERPETZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR PRODUCTS, EVEN IF CLEVERPETZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO CLEVERPETZ IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Lee County, North Carolina.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
